Real Estate, Home Financing & the LGBTQ+ Community

According to a study by the LGBTQ+ Real Estate Alliance, only 49% of the LGBTQ+ community own their home, compared to 66% of the overall population. Homeownership is even lower among LGBTQ+ racial minorities and transgender people. According to the 2019-2020 LGBT Real Estate Report:

  • The LGBTQ+ community is 73% more likely to be denied a loan, even though they are not at higher risk of default.
  • 46% of LGBTQ+ fear discrimination in their future home buying process.
  • 43% of LGBTQ+ couples feel anxious about how welcoming their new community/neighbors may be.

The Equality Act

The Fair Housing Act of 1968 was passed to protect homebuyers against discrimination. It covered discrimination because of race, ethnicity, religion, sex, national origin, and disability. It excluded protections for the LGBTQ+ community.

Fortunately, the Biden administration signed an executive order, the Equality Act, that could expand the 1964 Civil Right Act, to protect discrimination based on gender identity and sexual orientation.
